Bowen’s Party Emporium – Terms and Conditions

Please read these Terms and Conditions (“Terms”) carefully before placing an order with Bowen’s Party Emporium.
By placing an order or making payment, you agree to be bound by these Terms and Conditions.

1. Bookings and Deposits

All bookings are deemed provisional until a deposit has been received. Receipt of a deposit constitutes acceptance of these Terms and Conditions and secures your booking for the agreed date.
All deposits are non-refundable, unless cancellation is made by Bowen’s Party Emporium. We reserve the right to release any provisional booking if a deposit is not received within the specified timeframe.

Additional Terms:

All reservations remain provisional until the deposit has cleared.

Any variations or amendments to the booking must be agreed in writing.

We reserve the right to cancel a booking if full payment has not been received on the day of the event, delivery or collection. 

Our balloon products may contain latex. It is your responsibility to notify us in advance if you or any guests require non-latex alternatives.

2. Order Accuracy and Acceptance

Customers are responsible for reviewing and confirming all order details prior to collection or delivery. Any discrepancies, errors, or concerns must be reported before the handover of goods.
Once an order has been accepted, collected, or signed for, Bowen’s Party Emporium shall not be held liable for any subsequent issues, damages, losses, or changes requested thereafter.

Additional Terms:

Any variation to the Goods or Services after deposit or payment may incur additional charges.

All invoices will detail the full list of Goods or Services. Please ensure all information is correct before payment.

3. Customer Obligations and Information

Customers must provide full and accurate information when placing an order, including delivery addresses, access details, and event times.
Bowen’s Party Emporium cannot be held responsible for any delay, error, or non-fulfilment caused by incorrect or incomplete information supplied by the customer.

Additional Terms:

You agree to ensure the venue has appropriate access and facilities to accommodate delivery and installation.

If incorrect or incomplete details cause delivery issues, any resulting costs will be chargeable.

4. Cancellations and Amendments

All deposits are non-refundable under any circumstances, except where cancellation is made by Bowen’s Party Emporium.
In the unlikely event that Bowen’s Party Emporium cancels an order, a full refund of all monies paid will be issued.
Amendments to confirmed orders are subject to availability and may incur additional charges.

Additional Terms:

Cancellations must be received in writing.

The following charges will apply based on notice period:

0–7 days before event – 100% of total invoice

8–14 days before event – 75% of total invoice

15+ days before event – Loss of Deposit

5. Cooling-Off Policy

Under UK consumer law (Consumer Contracts Regulations 2013), customers who make purchases online, by telephone, or away from our premises may be entitled to a 14-day cooling-off period. However, due to the bespoke and time-sensitive nature of our work, this right does not apply in most cases.

All balloon arrangements, décor designs, and related products are created to order and often personalised to the customer’s specific requirements. As such, these items are classed as custom-made goods, and once preparation or material ordering has commenced, the right to cancel under the cooling-off period is waived.

By paying a deposit or confirming a booking, you give express consent for Bowen’s Party Emporium to begin work immediately, including ordering materials and scheduling production. If you wish to cancel your booking, please contact us as soon as possible — we will always aim to assist where we can, but deposits remain non-refundable once work has started.

This policy ensures we can maintain fairness to both our customers and our business, reflecting the bespoke nature of each order we create.

6. Late Payments and Debt Recovery

All payments must be made in accordance with the agreed payment terms stated on your invoice or booking confirmation. Failure to make payment by the due date may result in the suspension or cancellation of your booking.

If any balance remains unpaid after reasonable reminders, Bowen’s Party Emporium reserves the right to refer the outstanding debt to an external debt collection agency or take legal action to recover the amount owed. In such cases, the customer shall be liable for any additional costs incurred in recovering the debt, including but not limited to collection fees, court costs, and reasonable administrative expenses.

We strongly encourage open communication, if you are experiencing difficulty making a payment, please contact us as soon as possible so we can discuss potential options before further action is taken.

7. Delivery and Mileage Fees

Where delivery, setup, or collection is required, additional delivery and mileage fees may apply. Mileage is charged at a rate of £0.45 per mile, calculated from our business address to the delivery location and returning to our premises.

Delivery and mileage charges are separate from the quoted price of your balloon décor or services and may not always be included in the initial quotation, particularly where the delivery address is unknown at the time of booking. Any applicable delivery or mileage costs will always be clearly displayed on your final invoice.

If there is a change to the delivery address, Bowen’s Party Emporium must be notified in writing. Should this change result in additional charges, a new invoice will be issued to cover the revised cost, and payment must be received in full before the change is accepted or any further work continues. In the event that the new delivery address results in fewer miles than originally charged, no refund will be issued; however, a credit will be applied to your account to be used against any future booking with Bowen’s Party Emporium.

Delivery and/or collection times will be confirmed at the time of booking. Customers must ensure that access to the venue is safe, suitable, and available for delivery and installation. Bowen’s Party Emporium accepts no responsibility for delays, damages, or failed deliveries caused by restricted access, inaccurate information, or unsafe working conditions.

Late arrivals or failure to collect at the agreed time may result in order unavailability, and Bowen’s Party Emporium shall not be held liable for any resulting inconvenience or loss.

Additional Terms:

Customers must ensure suitable labour or access for delivery.

We are not liable for damages or costs resulting from poor access or unsafe conditions.

8. Hire Items, Returns, and Damages

Any hired items (including stands, frames, backdrops, lights, or props) remain the property of Bowen’s Party Emporium at all times.
A refundable damage deposit may be required for hire equipment. Customers are responsible for ensuring all hired items are returned in the same condition as provided.
Any lost, damaged, or unreturned items will be subject to replacement or repair costs, which will be deducted from the damage deposit or invoiced accordingly.

Additional Terms:

You are responsible for all hired Equipment from the time of delivery until collection.

Equipment must not be left outdoors overnight or during bad weather.

Lost or damaged items will be charged at full replacement value.

Full ownership of Equipment remains with Bowen’s Party Emporium at all times.

9. Balloon Care and Environmental Conditions

Balloons are delicate and affected by environmental conditions such as heat, humidity, wind, and direct sunlight.
Once the order has been handed over or installed, Bowen’s Party Emporium accepts no responsibility for the longevity or performance of balloons, including early deflation, colour fading, popping, or oxidation.
Helium balloons are designed to float for a limited time depending on size, material, and conditions. These times are estimates and not guaranteed.

Additional Terms:

We reserve the right to make substitutions where stock or manufacturer defects occur.

Balloons and décor items are not toys and should not be handled by unsupervised children.

10. Allergies, Safety, and Product Use

Some balloons contain latex, which may cause allergic reactions. It is the customer’s responsibility to notify Bowen’s Party Emporium of any known allergies prior to booking.
All products must be kept away from heat sources, sharp objects, and small children.
Warning: Balloons can present a choking or suffocation hazard. Children under 8 years of age should be supervised at all times.
Bowen’s Party Emporium accepts no liability for any injury, loss, or damage arising from the use or misuse of our products once handed over.

Additional Terms:

Do not inhale helium or release balloons outdoors.

Safe disposal of all décor and balloon materials is the customer’s responsibility.

11. Helium Safety Notice

All helium balloons supplied by Bowen’s Party Emporium are inflated and prepared by trained professionals for decorative and display purposes only.

Helium is a non-flammable gas, but inhaling it even in small amounts can be extremely dangerous, leading to dizziness, unconsciousness, or, in severe cases, fatal injury.
Helium-filled balloons should never be inhaled or deliberately deflated for this purpose.

Children should be supervised at all times when handling balloons, and care should be taken to avoid choking hazards from burst or deflated balloons.

Bowen’s Party Emporium accepts no responsibility for injury or damage caused by the misuse of helium balloons. By purchasing or accepting a helium-filled product from us, you agree to use it safely and responsibly.

12. Property Damage and Venue Responsibilities

While every effort is made to ensure installations are safe and non-damaging, Bowen’s Party Emporium cannot be held responsible for any damage to walls, ceilings, fixtures, or other property resulting from installation or removal.
Customers are responsible for obtaining any necessary permissions from the venue or property owner for décor installation, use of adhesives, or hanging methods.

13. Force Majeure

Bowen’s Party Emporium shall not be liable for any failure or delay in performance arising from circumstances beyond our reasonable control, including but not limited to extreme weather, transport issues, illness, strikes, or other unforeseen events.

14. Photography and Marketing

Bowen’s Party Emporium reserves the right to photograph completed décor or installations for marketing and promotional purposes, including on our website and social media platforms.
If you do not wish for photographs of your event décor to be used, please notify us in writing prior to the event.

15. Additional Terms and Bespoke Agreements

Certain bespoke or large-scale events may require additional terms or signed agreements. These form part of these Terms and Conditions and will be supplied where applicable.

Additional Terms:

We may subcontract or assign any part of our services without notice.

These Terms, along with your invoice, form the entire agreement between both parties.

16. Payments

All payments must be made to Bowen’s Group Ltd, the parent company of Bowen’s Party Emporium.
Accepted payment methods include bank transfer, debit/credit card, Klarna, or other approved options confirmed at the time of booking.
Full payment is required prior to collection or delivery unless otherwise agreed in writing.

Additional Terms:

All prices are valid for 30 days from quotation.

Late payments may incur interest charges in accordance with The Late Payment of Commercial Debts (Interest) Act 1998.

17. Liability Limitation

Bowen’s Party Emporium’s total liability for any claim shall be limited to the value of the order.
We shall not be liable for indirect, consequential, or financial loss (including loss of enjoyment or profit) arising from any failure in service, delay, or product defect.
This limitation does not apply to death or personal injury caused by negligence.

Bowen’s Party Emporium is a trading name of Bowen’s Group Ltd, a company registered in England and Wales.
